By REBECCA SANTANA, Associated Press WASHINGTON (AP) — The picture of who will be in charge of executing President-elect Donald Trump’s hard-line immigration and border policies has come into sharper focus after he announced his picks to head Customs and Border Protection and also the agency tasked with deporting immigrants in the country illegally. Trump said late Thursday he was tapping Rodney Scott, a former Border Patrol chief who’s been a vocal supporter of tougher enforcement measures, for CBP commissioner. As acting director of Immigration and Customs Enforcement, Trump said he’d nominate Caleb Vitello, a career ICE official with more than 23 years in the agency who most recently has been the assistant director for firearms and tactical programs. They will work with an immigration leadership team that includes South Dakota Gov. Kristi Noem as head of the Department of Homeland Security ; former acting Immigration and Customs Enforcement head Tom Homan as border czar ; and immigration hard-liner Stephen Miller as deputy chief of staff. Customs and Border Protection, with its roughly 60,000 employees, falls under the Department of Homeland Security. It includes the Border Patrol, which Scott led during Trump’s first term, and is essentially responsible for protecting the country’s borders while facilitating trade and travel. Scott comes to the job firmly from the Border Patrol side of the house. He became an agent in 1992 and spent much of his career in San Diego. When he joined the agency, San Diego was by far the busiest corridor for illegal crossings. Traffic plummeted after the government dramatically increased enforcement there, but critics note the effort pushed people to remote parts of California and Arizona. San Diego was also where wall construction began in the 1990s, which shaped Scott’s belief that barriers work. He was named San Diego sector chief in 2017. When he was appointed head of the border agency in January 2020, he enthusiastically embraced Trump’s policies. “He’s well known. He does know these issues and obviously is trusted by the administration,” said Gil Kerlikowske, the CBP commissioner under the Obama administration. Kerlikowske took issue with some of Scott’s past actions, including his refusal to fall in line with a Biden administration directive to stop using terms like “illegal alien” in favor of descriptions like “migrant,” and his decision as San Diego sector chief to fire tear gas into Mexico to disperse protesters. “You don’t launch projectiles into a foreign country,” Kerlikowske said. At the time Scott defended the agents’ decisions , saying they were being assaulted by “a hail of rocks.” While much of the focus of Trump’s administration may be on illegal immigration and security along the U.S.-Mexico border, Kerlikowske also stressed the importance of other parts of Customs and Border Protection’s mission. The agency is responsible for securing trade and international travel at airports, ports and land crossings around the country. Whoever runs the agency has to make sure that billions of dollars worth of trade and millions of passengers move swiftly and safely into and out of the country. And if Trump makes good on promises to ratchet up tariffs on Mexico, China and Canada, CBP will play an integral role in enforcing them. “There’s a huge amount of other responsibility on trade, on tourism, on cyber that take a significant amount of time and have a huge impact on the economy if it’s not done right,” Kerlikowske said. After being forced out under the Biden administration, Scott has been a vocal supporter of Trump’s hard-line immigration agenda. He has appeared frequently on Fox News and testified in Congress. He’s also a senior fellow at the Texas Public Policy Foundation. Wednesday's doubleheader on Netflix set records as the most-streamed NFL games in U.S. history, with numbers nearly five times more than the NBA. The Baltimore Ravens' 31-2 victory over the Houston Texans averaged 24.3 million while Kansas City's 29-10 win at Pittsburgh averaged 24.1 according to early viewer figures released by Nielsen on Thursday. Nielsen also said there were 65 million U.S. viewers who tuned in for at least one minute of one of the two games. The NBA's five-game slate averaged about 5.25 million viewers per game across ABC, ESPN and its platforms, according to the league and Nielsen. “I love the NFL,” James said in his televised postgame interview Wednesday night. “But Christmas is our day.” While the NBA's Christmas lineup has its best viewer numbers in five years, the NFL has made Christmas one of its tentpole events during the regular season, joining Kickoff Weekend and Thanksgiving. “The numbers speak for themselves and LeBron can have his own view, and I’m sure more people will look at that because of this," said Hans Schroeder, the executive vice president of NFL Media. Niphon | Istock | Getty Images China's race to develop smarter-than-human artificial intelligence may put it ahead of the U.S., but such ground-breaking technology could also risk lessening the stronghold that the ruling Communist Party has over the world's second-largest economy. That's the view of prominent AI scientist Max Tegmark, who told CNBC artificial general intelligence (AGI) is closer than we think and the narrative of a geopolitical battle between the U.S. and China racing to build the smartest AI is a "suicide race." While there is no singular definition of AGI, it is broadly taken to refer to AI that can outsmart humans. Applications like ChatGPT — that allow users to prompt a chatbot for answers — have exploded in popularity. But many AI companies are racing to develop the next level, with AI that has human-level intelligence. Sam Altman, the CEO of OpenAI, has said that AGI could be achieved by 2025. While there are other major names in the tech sector who also think AGI is close, many others think true AGI is still very far away . As well as competition between technology companies, there is also the geopolitical battle taking place between the U.S. and China for dominance in realms from AI to chips. While this is often portrayed as a race to be first to the latest technology, Tegmark said this is not the right framing. "I think of this battle, this geopolitical battle to build AGI first as a 'hopium war'," Tegmark told CNBC in an interview last month. " I call it the 'hopium war' because it's fueled by ... delusional hope that we can control AGI." Tegmark is the president of the Future of Life Institute, a thinktank which penned a letter last year calling for AI labs to pause the development of advanced AI systems . The letter was signed by major tech names including Tesla CEO Elon Musk . Tegmark's concern is that AI is advancing rapidly with very few guardrails in place, and no way to control it should it begin to outsmart humans. "We are much closer to building AGI than figuring out how to control it. And that means that the AGI race is not an arms race, it's a suicide race," Tegmark said. Is China worried about AGI? China has little incentive to build AGI, according to Tegmark. The AI scientist recalled a story in which Elon Musk told him about a "high level meeting" the Tesla boss had with Chinese government officials in early 2023. Musk said to the Chinese government that if AGI is built, China "will not be controlled by the Communist Party, but by the super intelligence," Tegmark said. "[Musk] got a very strong reaction. Some of them, really hadn't thought about that, and with less than a month from that, China came out with their first AI regulations," Tegmark said, referencing new regulation governing generative AI . China's ministry of foreign affairs was not immediately available for comment on the anecdote. CNBC also contacted Tesla for a response from Musk. "The U.S. doesn't need to convince China to not build AGI. Even if the U.S. didn't exist, the Chinese government would have an incentive to not build it because they want to be in control," Tegmark said. "[The] last thing they want is to lose that control." China's approach to AI AI is a strategic priority for the Chinese government. The country's biggest firms such as Alibaba , Huawei and Tencent have been developing their own AI models . The capabilities of those models are also advancing. China was also among the first countries in the world to bring in regulation around various aspects of AI . The country's internet is heavily censored and any information that appears to go against Beijing's ideology is blocked. OpenAI's ChatGPT is banned and it is well-noted that chatbots in China won't answer questions related to politics and topics deemed sensitive by the Communist Party. The country's approach to AI is therefore an attempt to push innovation while also balancing its own interests. When it comes to AGI, China is likely to pursue a similar approach, according to analysts. "I would not count on China to limit its own AI capabilities due to fears that such technologies would threaten Party rule. Similar predictions were made about the internet, they all proved to be false," Kendra Schaefer, a partner at consultancy Trivium China," told CNBC. "China will attempt to dominate AGI while creating a techno-regulatory apparatus that limits what AGI is permitted to do domestically." U.S.-China AI battle Despite Tegmark's view that the the race to build AGI is a "hopium war," geopoltiics remains front and center between the U.S. and China when it comes to development of the technology. And, in parallel, China wants to power its economy in new ways, from government efficiency to business applications," Prakash told CNBC. The U.S. has pursued a policy of attempting to restrict China's access to key technologies, mainly semiconductors like those designed by Nvidia , that are required to train more advanced AI models. China has responded by attempting to build its homegrown chip industry. Will the U.S. and China partner on AI rules? Technologists have warned of some of the risks and dangers when AGI does finally arrive. One theory is that without guardrails, AI will be able to improve itself and design new systems independently. Tegmark believes that any such risks will be realized by both the U.S. and China, which will force both countries' governments to individually come up with rules around AI safety. "So my optimistic path forward is the U.S. and China unilaterally impose national safety standards to prevent their own companies from doing harm and building uncontrollable AGI, not to appease the rivals superpowers, but just to protect themselves," Tegmark said. "After that happens though, there's this really interesting stage where the U.S. and China will be like, wait, how can we guarantee that North Korea doesn't build AGI or someone else? And then the U.S. and China have an incentive now to push the rest of the world to join them into an AGI moratorium." Indeed, governments are already trying to work together to figure out how to create regulations and frameworks around AI. Last year, the U.K. hosted an AI safety summit, which the U.S. and China were both in attendance, to discuss potential guardrails around the technology. But regulation and rules around AI are currently fragmented. This year, the European Union enacted the AI Act , the first major law globally governing the technology. China has its own set of rules, while many other countries have not yet moved to create any regulation. Tegmark's hope of co-ordination around AI safety is echoed by others. "When the dangers of competition are greater than the rewards, nations will ideally be motivated to come together and mutually self-regulate," Trivium China's Schaefer said. In a conversation with Bill Gates on the Unconfuse Me podcast, Sam Altman confirmed an upcoming release of GPT-5 that will be “fully multimodal with speech, image, code, and video support.” Altman said users can expect to see GPT-5 drop sometime in 2024. OpenAI is forming a Collective Alignment team of researchers and engineers to create a system for collecting and “encoding” public input on its models’ behaviors into OpenAI products and services. This comes as a part of OpenAI’s public program to award grants to fund experiments in setting up a “democratic process” for determining the rules AI systems follow. As it crossed the Niger Delta in 2021, a satellite imaged acres of bare land. The site outside the city of Port Harcourt was on a United Nations Environment Programme cleanup list, supposed to be restored to green farmland as the Delta was before thousands of oil spills turned it into a byword for pollution. Instead it was left a sandy “moonscape” unusable for farming, according to U.N. documents. It wasn’t the only botched cleanup, a cache of previously unreported investigations, emails, letters to Nigerian ministers and meeting minutes show. Senior U.N. officials considered the Nigerian cleanup agency a “total failure.” The agency, the Hydrocarbon Pollution Remediation Project, or Hyprep, selected cleanup contractors without relevant experience, a U.N. review found. It sent soil samples to laboratories lacking the equipment for tests they had claimed to perform. Auditors were physically blocked from checking that work had been completed. Most cleanup companies are owned by politicians, a former Nigerian environment minister told the AP, and correspondence shows similar views were shared by U.N. officials. It wasn’t supposed to be this way. There have been thousands of oil spills since Niger Delta production began in the 1950s. Reports and studies document that people often wash, drink, fish and cook in contaminated water. Spills still occur frequently. In November, the Ogboinbiri community in Bayelsa state suffered its fourth spill in three months, harming fields, streams and fishing. “We have not harvested anything," said farmer Timipre Bridget, there is now “no way to survive.” After a major U.N. pollution survey in 2011, oil companies agreed to a $1 billion cleanup fund for the worst-affected area, Ogoniland. Shell, the largest private oil and gas company in the country, contributed $300 million. The U.N. was relegated to an advisory role. The Nigerian government would handle the funds. But a confidential investigation by U.N. scientists last year found the site outside Port Harcourt was left with a “complete absence of topsoil,” with almost seven times more petroleum remaining than Nigerian health limits allow. The company responsible had its contract revoked, Nenibarini Zabbey, the current director of Hyprep, told the AP by email. The head of operations when the contract was awarded, Philip Shekwolo, called allegations in the U.N. documents “baseless" and "cheap blackmail.” Shekwolo, who used to head up oil spill remediation for Shell, insists the cleanup was successful. But the documents show U.N. officials raising the alarm since 2021, when Shekwolo was acting chief. A January 2022 U.N. review found 21 of the 41 contractors okayed to clean up spill sites had no relevant experience. These included construction companies and general merchants. They were effectively handed a “blank check,” U.N. Senior Project Advisor Iyenemi Kakulu is recorded saying in the minutes of a meeting with Hyprep and Shell. Incompetent companies were to blame for bad cleanups, Hyprep’s own communications chief, Joseph Kpobari is in the minutes as having said. Despite this, they were rewarded contracts for more polluted sites, the U.N. delegation warned. Zabbey denied Kpobari’s admission. He said 16 out of 20 sites in the project’s first stage are certified as clean by Nigerian regulators and many have been returned to communities. Hyprep always issued contracts correctly, he said. Two sources close to the cleanup efforts, speaking anonymously for fear of loss of business or employment, said when officials visited laboratories used by Hyprep, they lacked equipment needed to perform the tests they reported. In a letter to customers, one U.K. laboratory frequently used by Hyprep acknowledged its tests for most of 2022 were flawed and unreliable and the U.K. laboratory accreditation service confirmed the lab was twice suspended. Zabbey says now Hyprep monitors contractors more closely, labs adhere to Nigerian and U.N. recommendations and are frequently checked. The U.N. also warned the Nigerian government in a 2021 assessment that Hyprep’s spending was not being tracked. Internal auditors were considered “the enemy” and “demonized for doing their job.” Shekwolo’s predecessor as Hyprep chief blocked financial controls and “physically prevented” auditors from checking that work had been completed, it found. Zabbey responded that the audit team is valued now, and accounts are audited annually, although he provided only one audit cover letter. In it, the accountants “identified weaknesses.” One Nigerian politician tried to change things: Sharon Ikeazor spent decades as a lawyer before becoming environment minister in 2019. “The companies had no competence whatsoever,” she said in a phone interview. In February 2022, she received a letter from senior U.N. official Muralee Thummarukudy, warning of “significant opportunities for malpractice" over contract awards, unusually strong language in U.N. diplomacy. She removed Shekwolo as acting Hyprep chief the next month, explaining that she believed he was too close to the politicians. Most cleanup companies were owned by politicians, she said. The few competent companies “wouldn’t get the big jobs.” Shekwolo assessed who was competent for contract awards, Ikeazor said. Shekwolo’s former employer Shell and the U.N. both warned her about him, she said, something Shekwolo says he was unaware of. Ikeazor asked Shekwolo’s successor to review every suspect contract and investigate the cleanup companies. “That sent shockwaves around the political class,” she said. She was quickly replaced as environment minister, with Shekwolo rehired, after just two months out of office. Shekwolo denied being too close to politicians. He insists no reason was given for his removal and suggested Ikeazor simply didn’t like him. Last year, the U.N. Environment Programme ended its official involvement in the Nigerian oil spill cleanup, explaining its five-year consultancy was over. Ikeazor said the real reason was U.N. frustration over corruption, and the two sources close to the project concurred. Zabbey said he believes the U.N. merely changed its goals and moved on.
